The Jones Act - Maritime Injury Attorney in Mississippi

Because offshore workers perform a function that is both dangerous and necessary to our society, the Jones Act was created to encourage employers to keep the working conditions on their vessels as safe as possible. This encouragement comes in the form of giving injured seamen including offshore oil workers (or their bereaved families) the right to sue the employer for damages in a personal injury or wrongful death lawsuit, instead of settling only for workers' compensation.

Does the Jones Act Apply to My Case?

The Jones Act applies to any injury to an seaman or offshore oil drilling worker that was sustained on any mobile seafaring vessel while it was on a navigable waterway. Navigable waterways include both the Gulf of Mexico and the Mississippi River, and a mobile vessel can include:

  • Offshore oil drilling platforms and rigs
  • Barges
  • Tugboats
  • Cruise ships
  • Crew boats

If your offshore worker injury fits these two criteria, the Jones Act allows you to sue your employer for personal injury damages. Not only that, the Jones Act requires a Lower standard of evidence (what's referred to as a "preponderance of the evidence") in order to prove liability.
